Why does Allstate have to be such jerks?

Got into an accident that was not my fault. My hospital bill was well over 18,000 and that is not counting out of pocket expenses, follow up doctor visits for my injury. The persons insurance PIP coverage is 10 grand and that they have to pay 10 grand of the bill. the adjuster then said what I get in pain and suffering can go towards the remaining amount of medical bills. My coverage is lower then the person who caused this so I cannot make a claim under my under-insured..Got a copy of payments made by ALLstate today showing what they will pay and what they cannot. They paid 300.00 of my bill with a balance of a little over 18,000 remaining. They stated that the reason why is because all of my benefits are exhausted! 300.00 does not sound like 10 grand. Can they get in trouble for bad faith if this is not resolved and because they did not honor the amount they said they would pay? what a crock...Allstate is a crock.
